By booking a course, you acknowledge that you have read and agree to these Terms & Conditions.

RideSmart Motorcycle Training has been proudly family owned and operated since 2002. From day one, our mission has been simple: to help every rider gain the skills, confidence, and knowledge to ride safely—and enjoyably. Over the years, our small but passionate team of instructors and support staff has grown, but our focus remains the same: guiding you every step of your riding journey.

These Terms & Conditions are designed to ensure your learning experience is safe, structured, and positive. They make it clear what’s expected from both you and our team, so you can focus on building skills and confidence.

1. Eligibility Requirements

All participants are responsible for ensuring they meet all Transport & Main Roads (TMR) licensing requirements before enrolling.
RideSmart does not check or confirm eligibility on behalf of students. You can check eligibility HERE.

If a participant books a course and is later found to be ineligible, no refund or reschedule will be provided.
Students who arrive without the required physical or digital licence will be refused entry with no refund.
Students who arrive without the required Eligibility Certificate (physical or digital) will be refused entry with no refund.
Students who hold an interstate or international licence must provide a physical or digital copy of their TMR eligibility check. If this cannot be provided on arrival, entry will be refused and no refund will be issued.

1.1 Pre-Learner Q-Ride Course
To enrol, students must:

Hold a current P1, P2, or Open class C (car) licence and,
Have held that licence for at least 12 months.
Interstate/International licence holders have the required letter from TMR confirming eligibility

1.2 RE (Restricted) Q-Ride Course
To enrol, students must:

Hold a valid RE Learner Licence (RE L) and,
Have held their RE L for a minimum of 90 days and,
Have successfully completed the Motorcycle Knowledge Test HERE and Motorcycle Hazard Perception Test HERE.
Interstate/International licence holders have the required letter from TMR confirming eligibility
If you are a returning driver/rider you must produce a letter from TMR

1.3 R (Unrestricted) Q-Ride Course
To enrol, students must:

Hold a valid RE (Restricted) motorcycle licence and,
Have held that licence for at least 2 years,
Interstate/International licence holders have the required letter from TMR confirming eligibility
If you are a returning driver/rider you must produce a letter from TMR

1.4 Additional Training Courses
(1-on-1 Training and Group Training) to enrol, students must:

Students must hold a current Queensland motorcycle or car licence applicable to the training being delivered.

2. Payment Policy

Full payment is required at the time of booking.
If an invoice is issued, the balance must be paid within 24 hours, otherwise your booking will be released.
RideSmart may attempt to contact unpaid bookings, but unpaid bookings will be cancelled, and the position will be released to other students.

3. Reschedule & Cancellation Policy

3.1 Rescheduling

More than 21 days before course — Free reschedule.
7–21 days before course — $50 rescheduling fee.
Less than 7 days before course — Full course fee forfeited.

3.2 Cancellations

More than 21 days before course — Full refund.
7–21 days before course — Partial credit may be offered at RideSmart’s discretion.
Less than 7 days / No-show / Late arrival (more than 10 minutes late on course start time) — No refund or credit.

3.3 No-Show Definition
A no-show occurs if you:

Fail to attend the course.
Cancel on the day of the course.
If you are sick, please refer to section 6.4 – No-Show Due to Medical Reasons for our medical certificate requirements.
*Arrive more than 10 minutes late.
Cancel with less than 7 days’ notice, including for weather, work, vehicle issues, or other reasons.

* Late arrival disrupts safety and course sequencing. Traffic, parking issues, delays, navigation errors, weather, personal delays do not exempt this policy.

3.4 Course Credits

Credits may be issued instead of a refund at RideSmart’s discretion.
Credits must be used within 3 months for any future course of equal or lesser value.
Credits cannot be exchanged for cash.

4. Infringements

Students are fully responsible for any traffic infringements, fines, or penalties incurred while riding any motorcycle, whether a school-provided bike or their own, during training. RideSmart accepts no responsibility for these fines. Students must always comply with all road rules and *pay any fines or penalties issued in full. This includes, but is not limited to, speeding, illegal parking, or other traffic violations.

* Students will be notified of any infringements, fines or penalties incurred and are required to pay within 14 days of notice.

5. Weather Policy

RideSmart operates year-round, and courses commence as scheduled unless otherwise advised.
Training continues in most conditions including:

rain *
heat
sun/overcast
humidity
wind

Training does not continue in:

lightning storms
hail
severe weather events where the trainer or RideSmart determines it is unsafe.

Due to Queensland’s unpredictable weather, all courses begin as normal, and safety decisions may be made on the day. Wet weather is not grounds for cancellation, reschedule, or refund. * Wet weather jacket and pants will be provided if it is raining.

6. Medical Conditions & Medical Clearance

6.1 Participant Fitness & Health
All students must be physically and mentally fit to participate in RideSmart courses. Students must disclose any medical conditions, injuries, or medications that may affect their riding ability. Failure to do so may result in removal from the course and forfeiture of fees.

6.2 Medical Licence Conditions
Students with medical licence conditions must hold appropriate medical clearance from TMR and be safe to ride. Students must supply RideSmart with a copy of their medical clearance prior to commencing their course.

6.3 Medical Events During Training
If a student experiences a medical event during any RideSmart course:

The student will be stopped from continuing.
A medical clearance certificate will be required before returning to training.

No refund or reschedule is provided for medical events unless the student later provides valid evidence and RideSmart management approves a credit. Evidence must be provided to RideSmart within 7 days

6.4 No-Show Due to Medical Reasons
If a student is classified as a no-show due to illness or a medical event, they must provide a valid medical certificate to RideSmart within 7 days of the course date. Submission of a medical certificate allows RideSmart management to review and potentially approve a credit or reschedule. Failure to provide evidence within 7 days will result in forfeiture of course fees in line with the 3.3 No-Show policy.

7. Behaviour, Conduct & Safety Removal Policy

RideSmart is committed to providing a safe, respectful, and lawful training environment for all participants. Students may be removed from training and marked Not Yet Competent (NYC) if their behaviour:

Compromises safety,
Breaches compliance requirements, or
Disrupts the training session, even if some individual tasks have been completed successfully.

7.1 Immediate Removal (No Prompts)
Students may be removed without warning for:

Serious or immediate safety risks,
Aggressive, hostile, or confrontational behaviour,
Refusal to follow critical safety instructions,
Any behaviour that compromises the safety of others.

7.2 Removal After Repeated Prompts
If behaviour is not immediately unsafe, trainers will:

Provide corrective guidance and prompts,
Issue a clear final warning,
Remove the participant if unsafe or disruptive behaviour continues.

Examples of behaviours that may lead to removal include:

Riding too fast or unpredictably,
Failing to maintain safe distances,
Ignoring instructions or safety directions,
Disruptive, disrespectful, or argumentative behaviour,
Refusing to participate in required theory or practical activities.

Note: Demonstrated competency on individual tasks does not override overall safety. Safety always comes first. Trainers are the sole assessors of safety and competence. Their decision is final and not negotiable.

Competency never overrides safety.

7.3 Alcohol, Drugs & Impairment

Students must not attend courses under the influence of alcohol, drugs, or any substances that may impair their ability to ride safely.
Trainers may remove any student suspected of being impaired. Removal for this reason will result in no refund or reschedule.
Safety of the student, other participants, and the instructor is paramount — impaired riding will not be tolerated.

8. Equipment & PPE Requirements

RideSmart provides at no charge:

motorcycle,
helmet,
gloves,
jacket,
wet weather jacket/pants,

Students must bring:

current driver licence (physical or digital) & eligibility certificate or interstate/international eligibility letter,
long pants,
enclosed shoes,
* water/snacks/lunch,
* sunscreen,

Students arriving without correct PPE may be refused entry with no refund. *are optional but strongly advised.

You’re more than welcome to bring your own helmet, jacket and gloves. Many students feel more comfortable in their personal gear, and you’re encouraged to use it if you prefer.

9. Motorcycles – Fitness, Safety & Insurance Requirements

9.1 Personal Motorcycles & Insurance Requirements
RideSmart strongly recommends using our supplied motorcycles for ALL courses.

If a student chooses to bring their own motorcycle, the following conditions must be met prior to course commencement:

The motorcycle must be 100% roadworthy, fully registered, and correctly classed for the course (LAMS or non-LAMS as applicable).
The motorcycle must be safe to operate and suitable for the training environment. RideSmart reserves the right to refuse any motorcycle deemed unfit, in which case the student will be removed from the course and all fees forfeited.
Students must provide proof from their insurance provider confirming that:
- The insurance policy is fully comprehensive,
- By using your own motorcycle, you acknowledge that your insurance provider may or may not cover the use of the motorcycle in a training environment, and that RideSmart accepts no liability for private motorcycle use.

Important: Failure to provide appropriate proof of comprehensive insurance or presenting a motorcycle that does not meet the above requirements, will result in immediate removal from the course without refund.

Why we recommend using RideSmart motorcycles:

Ensures all motorcycles meet safety standards,
Reduces administrative and insurance burden for students,
Provides a consistent training experience, across all RideSmart locations
Avoids potential liability issues for both student and RideSmart.

By bringing a personal motorcycle, students accept full responsibility for compliance, insurance, and risk, and acknowledge that RideSmart may refuse their motorcycle at any time if requirements are not fully met.

9.2 Equipment Damage
RideSmart provides motorcycles, PPE, and other training equipment for student use. Non-malicious damage during training is covered by RideSmart.
Damage caused as a result of:

Failure to follow instructor instructions,
Unsafe riding after repeated guidance, or
Behaviour that results in NYC removal,
will be the responsibility of the student.
In Pre-Learner (RE-L) and Restricted (RE) courses, minor accidents are understood as part of the learning process and will generally not incur student charges. Subject to RideSmart’s discretion.
In Unrestricted R courses, all damage caused by the student will be charged to the student, due to the increased skill expectation and higher-risk environment.
In 1-on-1 Training and Group Training minor accidents are understood as part of the learning process and will generally not incur student charges. Subject to RideSmart’s discretion.
Students will be notified of damage costs and are required to pay within 14 days of notice.

10. Gift Vouchers

Valid for 3 years from date of purchase.
Not redeemable for cash.
Non-refundable.
If the voucher value is lower than the course cost, the student must pay the difference.

11. Photography & Marketing Permissions

RideSmart may take photos or videos during courses for marketing and promotional purposes. Students automatically consent unless they notify staff before training begins.

We will record your request and ensure you are not included in any photography or marketing materials.

12. Privacy & Data Use

RideSmart collects only the personal information required for training, certification and administrative purposes.
Information is stored securely and handled in accordance with Australian privacy laws.

We do not sell or disclose personal information to unrelated third parties.

13. Limitation of Liability

RideSmart is not liable for:

loss caused by a student’s failure to meet licensing or eligibility requirements,
personal belongings lost or damaged while on site,
injuries caused by another participant,
missed bookings due to incorrect personal information.

Students participate at their own risk and must follow all safety directions. Nothing in these Terms & Conditions limits any rights you may have under the Australian Consumer Law (ACL).

14. Complaints & Feedback

RideSmart encourages open communication.

All complaints will be handled promptly, respectfully and confidentially.

15. Acceptance of Terms

By booking with RideSmart Motorcycle Training, the participant agrees to:

comply with all Terms & Conditions,
follow all instructions and safety directions,
ensure they meet TMR eligibility requirements,
accept that the trainer’s decision is final,
accept that refunds and reschedules are governed exclusively by this policy,
acknowledge that RideSmart reserves the right to cancel or reschedule courses due to unforeseen circumstances (e.g., weather, emergencies, instructor illness), with refunds or credits issued at RideSmart’s discretion.
